Can I get in trouble for recording police interactions?

There is no law in Canada against filming or audio-recording the police. However, you are not permitted to obstruct a police officer in the course of their duty. For example, if you are filming police and they ask you to move out of the way, you should comply.

Generally speaking, it is best to comply with police officers’ requests. However, if you feel that police are exercising excessive force or otherwise violating civil rights, video/audio evidence can be extremely useful in a criminal proceeding, or when filing a complaint with the Office of the Independent Police Review Director.

If have been charged with obstructing an officer by recording their actions, it is imperative you contact a lawyer as soon as possible. Call us at (905) 541-2228 available 24/7 or fill out our free consultation form.
