Background:
Mr. G was charged with two counts of sexual assault and interference, stemming from allegations made by his niece. It was alleged that Mr. G had groped the complainant over the course of one weekend, while he was acting as a caretaker for her and her younger brother.
The Issue:
Mr. G was represented by counsel Natalia Pawlowski. After a three day trial with testimony from the complainant and various family members, Mr. G was acquitted of both charges against him.
Result:
The Court agreed with counsel that the story told by the complainant had materially changed over time, and that new allegations were also made for the first time at trial. Further, the court found that the witnesses had colluded their evidence, after cross-examination by Ms. Pawlowski established the particular points of collusion. Mr. G was able to return to his life after trial after many months of steadfastly maintaining his innocence.
