Background:
Mr. M was charged with one count each of sexual assault and sexual interference, both historic in nature.
The Issue:
The complainant was his younger cousin who alleged that he, while around age 23, had fondled her, while she was around the age of 12. The allegation was particularly serious given the characterization of the nature of the relationship between the parties being that of one of trust or authority. The Crown would have sought penitentiary time, had Mr. M been convicted.
The Result:
After two days of grueling cross examination at trial by Ms. Pawlowski, Crown counsel sought a dismissal of all charges against Mr. M, finding that no reasonable prospect of conviction remained after cross-examination. Mr. M was able to clear his name without even having to finish the remainder of the trial.
