In this case counsel Natalia Pawlowski ran a highly contested bail hearing for her client, who presented to the court with 27 gun and drug related charges, as well as allegations of breaching a prior release order. The charges were laid after the execution of a search warrant on a private residence, after a tip to police. The Crown was opposed to the release of Ms. Pawlowski’s client based on the very serious nature of the allegations, as well as the overall community perspective on the initial charges as well as the new allegations of breaching a prior release order.
Ms. Pawlowski engaged in extensive preparation of a surety in advance of the bail hearing, and provided the court extensive authorities which supported the defense position of release of the client. Ms. Pawlowski presented reasoned and comprehensive submissions regarding flaws in the Crown’s case, issues with the searches, and motivations of the informant to fabricate allegations. After hearing her submissions, and hearing from the surety, Mr. T. T. was released on bail to a non-residential surety, with a lower financial pledge than initially presented during his prior bail hearing. Mr. T.T. was able to obtain a job, and is able to work and support himself while on release, instead of spending his time in custody awaiting trial.
