Background:
Mr. G was alleged to have participated in a group robbery of a young person. He was initially identified by two people as being part of the group. Surveillance footage of the robbery also existed, which confirmed that the incident occurred.
The Issue:
The issue in this case was the identity of the robbery participants, and whether it could be established that Mr. G was involved in the robbery.
Result:
A short and sharp cross-examination by Ms. Pawlowski, Mr. G’s counsel, revealed that the two witnesses who identified Mr. G were not at all in a position to be able to make any positive identifications, and in fact did not know him personally enough to know any identifiers about him. Mr. G was acquitted of robbery after the Court agreed that his identity could not be proven as part of the group
