Background:
Mr. M was charged with a series of domestic-related allegations against a former partner, including sexual assault.
The Issue:
He was represented by counsel Natalia Pawlowski. Counsel brought an application before trial to admit into evidence various recordings and text message conversations between Mr. M and the complainant which Mr. M had kept records of.
Result:
The application was successful. At trial, counsel used this evidence within a thorough cross-examination of the complainant to materially contradict her evidence on all allegations. At the close of the trial, the Crown invited a dismissal on the charge of assault. The Court, in regard to the remaining charges, found the complainant’s evidence to be severely incredible and unreliable. The court agreed with counsel Pawlowski that she could not provide significant details, and many of her allegations were implausible based on other parts of her testimony. Mr. M was acquitted of his charges and did not have to testify in his own defence.
